During the preliminary hearing on Tuesday, a detective testified that an independent witness told detectives he saw Megan and her friend and former assistant, Kelsey Harris, quarrel only moments before Megan was shot in the foot on July 12, 2020. According to the witness, the gun’s muzzle flash hit Kelsey rather than Tory.

The evidence, according to Tory’s team, raises issues and casts doubt on Meg’s claim that Tory was the shooter.

According to Tory’s attorney, Shawn Holley, ” Megan herself corroborated this account, telling officers shortly after the incident that the argument was between her and the other female passenger in the car. The independent witness also stated that the muzzle flash was closest to the other female, which is supported by gunshot residue discovered on the other female’s hands.”

Holley adds, “It was further established that Megan gave several inconsistent accounts of what happened that night and that she omitted key information to the police. We look forward to the opportunity to cross examine her at trial about the numerous inconsistencies in her story.”

Holley is referring to Meg informing responding officers that her wounds was caused by broken glass rather than a bullet, according to TMZ. She had previously stated that in the aftermath of the George Floyd shooting, she was afraid that if she told officers that a Black guy had shot her, they would shoot her.

Megan took to Twitter to criticize the media for attempting to divert attention away from the fact that she had been shot.

Detective Ryan Stogner of the Los Angeles Police Department said Tuesday that a “intoxicated” Lanez yelled, “Dance bitch, dance!” before shooting Meg in the foot, and that he afterwards apologized to Kelsey for doing something while inebriated.

A judge was persuaded by Stogner’s testimony that Tory should face felony charges. Prior to the ruling, Holley speculated that Kelsey grew enraged after Tory said in the car that he and Megan had slept together, and that Kelsey might have been in possession of the gun that shot Megan.

The trial is now planned to start on January 13th. Tory is charged with one count of assault with a semiautomatic firearm resulting in serious bodily injury and one count of carrying an unlicensed weapon concealed. He faces a maximum term of 22 years and eight months in state prison if convicted.
